1. ACCEPTANCE OF TERMS

By downloading, installing, or using the Pocket Marcus mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. DESCRIPTION OF SERVICE

Pocket Marcus is a mobile application that provides AI-powered philosophical guidance and conversations inspired by the teachings of Marcus Aurelius and Stoic philosophy. The App offers various subscription tiers with different features and message limits.

3. SUBSCRIPTION TERMS

3.1 Auto-Renewable Subscriptions

• Student Monthly: €2.99 per month - 50 messages per day with Brief & Medium responses, Stoicism, Ethics & Balanced wisdom
• Philosopher Monthly: €4.99 per month - 120 messages per day with Brief, Medium & Detailed responses, All focuses unlocked
• Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends
• Payment will be charged to your iTunes Account at confirmation of purchase

3.2 Free Tier

• Scholar Tier: Free with your own API keys (OpenAI, Anthropic, or Google Gemini)
• You are responsible for your own API usage costs with third-party providers
• No message limits when using your own API keys

3.3 Cancellation

• You can cancel your subscription at any time through your App Store Account Settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months of service

4. ACCEPTABLE USE

4.1 Permitted Uses

• Personal philosophical reflection and learning
• Educational purposes related to Stoic philosophy
• General life guidance and wisdom seeking

4.2 Prohibited Uses

• Harassment, abuse, or harmful content
• Illegal activities or promoting violence
• Sharing or distributing inappropriate content
• Attempting to reverse engineer or modify the App
• Commercial use without permission

5. INTELLECTUAL PROPERTY

The App and its content, including but not limited to text, graphics, images, logos, and software, are owned by Pocket Marcus and are protected by copyright and other intellectual property laws. The teachings and quotes attributed to Marcus Aurelius are in the public domain.

6. AI SERVICES DISCLAIMER

The App uses third-party AI services (OpenAI, Anthropic, Google Gemini, Ollama) to generate responses. While we strive for accuracy and helpfulness, AI-generated content may not always be accurate, complete, or suitable for your specific situation. The responses are for informational and educational purposes only.

7. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Pocket Marcus shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses resulting from your use of the App.

8. DISCLAIMERS

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the App will be uninterrupted, secure, or error-free. AI responses are generated automatically and may not reflect the actual views or teachings of Marcus Aurelius.

9. PRIVACY

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App, to understand our practices regarding the collection and use of your information.

10. MODIFICATIONS

We may modify these Terms at any time. We will notify you of any changes by posting the new Terms in the App. Your continued use of the App after such modifications constitutes your acceptance of the new Terms.

11. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

13. EFFECTIVE DATE

These Terms of Use are effective as of January 15, 2025.
